Crisis Looms As More APC Members Demand Buni Removal, Cancel All Actions Of Committee

Some members of the ruling All Progressives Congress (APC)have dragged the Yobe Governor, Mai Buni and the Caretaker Committee to court

They are demanding the sack of Buni, the 13-member national committee, as well as the nullification of all their actions.

They joined the Independent National Electoral Commission (INEC) and the Attorney General and Justice Minister, Abubakar Malami in the suit

The summon is registered in suit no FHC/ABJ/CS/938/2021 and a motion for interlocutory injunction were filed by their lawyer, Samuel Irabor at the Federal High Court.

The plaintiffs presented grounds to back their request for the removal of the national leadership.

They claimed that the 13 member caretaker committee does not meet the up with the constitutional requirements which requires 24 members spread across not less than two-third of the 36 States and the FCT.

The suit cited Section 223(2)(b) of the 1999 constitution (as amended).

They also said that it is prohibited for a sitting Governor to hold dual executive positions as sited in by Section 183 of the 1999 Constitution and Article 17(4) of the APC Constitution, 2014 (as amended)

They insisted that by Article 13(4)(xvi) of the APC Constitution, 2014 (as amended), the National Working Committee (NWC), not the National Executive Committee (NEC), can constitute a caretaker committee.

The suit also wants Malami reprimanded for administering oath of office on Buni.

“The AGF lacks the powers to do so under any provision of the APC Constitution, 2014 (as amended) as he is neither a member of the NWC or NEC of the APC”, it reads.
